Originally published in 1907, this book contains the ancient Greek text of Aristotle's De Anima, his treatise on the differing souls of living things. An English translation is provided on each facing page, and Hicks supplies a very detailed commentary on each line at the end of the book, as well as a summary of each section. This book will be of value to anyone with an interest in Greek philosophy and the history of classical scholarship.

In recent years, the "science of science" has combined computational methods with novel data sources in order to understand the dynamics of research communities. As the name suggests, science of science is primarily focused on science and technology, with less attention to the humanities. However, many of the questions investigated by science of science are also relevant to academic philosophy: To what extent can the discipline be divided into subfields with different methods and topics? How are prestige and credit distributed (...) across the discipline? And how do these factors interact with other factors, such as gender, to shape job market outcomes? In this paper, we provide some empirically-informed answers to these questions by applying computational methods to job market data for Anglophone academic philosophy. We find, first, evidence that is consistent with the analytic-continental divide, but is also consistent with other, more complex ways of organizing academic philosophy into distinct intellectual traditions; second, a clear prestige hierarchy, dividing PhD programs into two distinct prestige categories; and third, evidence that gender, prestige, and country have notable effects on academic job market outcomes for recent philosophy PhDs. I offer counters to his array of arguments, and point to what I see as a fundamental flaw in his philosophy of religion. He appealed to religious language as used by ordinary religious persons. But his account of the meaning of this language was not that of the ordinary religious believer. He thus claimed, by implication, to know better than they did what they really (...) meant. In this paper, I hope to reintroduce debate on the issue of aesthetic supervenience, especially in light of work undertaken by metaphysicians in recent years. After providing a brief walkthrough of some of the major views on supervenience generally, including several important metaphysical distinctions, I build upon views by Jerrold Levinson, John Bender, Nick Zangwill, and Gregory Currie, to develop a realist thesis of strong local supervenience, such that aesthetic properties of artworks and other objects depend upon their formal/structural properties (...) and reduce to powers to produce aesthetic effects of particular kinds in suitable perceivers under suitable conditions. In 2003, a photograph taken by Richard Prince, Untitled (Cowboy) , sold at auction for $332,300. Some might be surprised that a photograph could garner such a sum, but, in this case at least, none more so than Jim Krantz. Krantz might be allowed a certain level of incredulity, for Prince's photograph was a photograph of another photograph, this one taken by Krantz himself. As far as copyright is concerned, Krantz's photograph and Prince's are the same work, and so Krantz (...) is almost certainly infringing on Prince. Copyright protects ‘authored works’, and not art works per se . And unfortunately, while copyright law assumes some metaphysical basis to its objects, this basis tends to go largely uninvestigated. In this paper, I work to develop a comprehensive, coherent, and consistent account of the ontology of authored works suitable for the purposes of copyright law. (shrink)

BackgroundIn the Canadian Alliance for Healthy Hearts and Minds (CAHHM) cohort, participants underwent magnetic resonance imaging (MRI) of the brain, heart, and abdomen, that generated incidental findings (IFs). The approach to managing these unexpected results remain a complex issue. Our objectives were to describe the CAHHM policy for the management of IFs, to understand the impact of disclosing IFs to healthy research participants, and to reflect on the ethical obligations of researchers in future MRI studies.MethodsBetween 2013 and 2019, 8252 participants (...) (mean age 58 ± 9 years, 54% women) were recruited with a follow-up questionnaire administered to 909 participants (40% response rate) at 1-year. The CAHHM policy followed a restricted approach, whereby routine feedback on IFs was not provided. Only IFs of severe structural abnormalities were reported.ResultsSevere structural abnormalities occurred in 8.3% (95% confidence interval 7.7–8.9%) of participants, with the highest proportions found in the brain (4.2%) and abdomen (3.1%). The majority of participants (97%) informed of an IF reported no change in quality of life, with 3% of participants reporting that the knowledge of an IF negatively impacted their quality of life. Furthermore, 50% reported increased stress in learning about an IF, and in 95%, the discovery of an IF did not adversely impact his/her life insurance policy. Most participants (90%) would enrol in the study again and perceived the MRI scan to be beneficial, regardless of whether they were informed of IFs. While the implications of a restricted approach to IF management was perceived to be mostly positive, a degree of diagnostic misconception was present amongst participants, indicating the importance of a more thorough consent process to support participant autonomy.ConclusionThe management of IFs from research MRI scans remain a challenging issue, as participants may experience stress and a reduced quality of life when IFs are disclosed. The restricted approach to IF management in CAHHM demonstrated a fair fulfillment of the overarching ethical principles of respect for autonomy, concern for wellbeing, and justice. The translational research community, in general, and the Clinical and Translational Science Awards (CTSA) community, in particular, share the vision of repurposing EHRs for research that will improve the quality of clinical practice. Many members of these communities are also aware that electronic health records (EHRs) suffer limitations of data becoming poorly structured, biased, and unusable out of original context. This creates obstacles to the continuity of care, utility, quality improvement, and translational research. Analogous limitations to sharing objective data in (...) other areas of the natural sciences have been successfully overcome by developing and using common ontologies. This White Paper presents the authors’ rationale for the use of ontologies with computable semantics for the improvement of clinical data quality and EHR usability formulated for researchers with a stake in clinical and translational science and who are advocates for the use of information technology in medicine but at the same time are concerned by current major shortfalls. This White Paper outlines pitfalls, opportunities, and solutions and recommends increased investment in research and development of ontologies with computable semantics for a new generation of EHRs. This paper is a reply to D'Costa's article ("Religious Studies," 32, pp. 223-32) in which he argues that there is no such position as religious pluralism because in distinguishing between, e.g., Christianity or Buddhism, and Nazism or the Jim Jones cult, a criterion is involved and to use a criterion is a form of exclusivism. In reply I point out that this sense of 'exclusivism', as consisting in the use of criteria, is self-destructive; that the pluralistic hypothesis, as a meta-theory (...) about the religions, has a different logical status from the creeds of the historical religions; and I also show the origin of the ethnical criterion used by the religious pluralist who stands within one or other of the great world faiths. The author, a member of the faculty in philosophy at Visva-Bharati University, produced this volume under appointment as Visiting Fellow at the Indian Institute of Advanced Study, after having studied in England. These four essays are concerned with recent analytic thought, concentrating upon the problem of identity and the experiments of reflection which have appeared in modern British philosophy, such as Strawson’s world of nothing but sound. Chandra’s central concern is to analyse the relationship between identity and continuity, and to (...) show that these concepts are not identical. Thus the book is an extended essay in conceptual clarification and logical geography. Saying that a is identical with b is not to say that a is continuous with b. All of this is undertaken because the author finds this inappropriate identification pervasive in contemporary philosophy, and the source of considerable logical confusion, especially in the consideration of personal identity. As an underlying theme attention is also focused upon the relevance of this issue to the debate concerning philosophical skepticism. Strawson’s sound world is seen as an attempt to refute the skeptic, which attempt fails because of Strawson’s failure to distinguish between identity and continuity. With the failure of Strawson’s attack upon the skeptic, and perhaps the phenomenalist as well, his defense of material bodies is thereby undermined. In addition to Strawson, Chandra studies Price, Ryle, Hick, and the very recent work on personal identity by Parfit. The author concludes that identity is consistent with discontinuous existence. He also offers an analysis of after-images, including not only visual after-images but after-images of taste as well. A further underlying theme is the use of science in such thought experiments, for they are frequently presented as if they were of a scientific character, thus exaggerating scientific capabilities. However, the nature of the relationship between philosophy and science is hardly clarified, and the nature of scientific limits remains vague throughout the book. Chandra has isolated a unique feature of contemporary analytic philosophy for consideration, for few others have so concentrated upon this strange feature of thought experiment which pervades British philosophy, nor the identification of identity and continuity. The book would have been improved tremendously, however, if the author had only indicated much more clearly than he does the philosophical conclusions which he wishes to draw from his reflections. John Hick’s revolutionary, “Copernican” approach to religious diversity received a great deal of criticism in his lifetime from more conservative theologians and philosophers of religion, many of whom were seeking to preserve a unique place of pre-eminence for Christianity amongst the world’s faiths. Critical responses to Hick’s Pluralistic Hypothesis have also emerged, however, from amongst his fellow religious pluralists, who have sought either to build upon or to go beyond his pivotal and groundbreaking work. In the same spirit as the (...) responses given by this latter group, this chapter will seek to look beyond Hick’s important work, certainly not in an unfriendly fashion, but with the understanding that Hick is the proverbial “giant” upon whose shoulders subsequent generations of pluralists are standing as we seek to advance pluralism even further than he did in his work. Specifically, this chapter will draw on the Jain concepts of anekāntavāda, nayavāda, and syādvāda, as well as the thought of Alfred North Whitehead and his successors in the movement of process philosophy, to reconceptualize the Real, not on a Kantian foundation, as is done in the Pluralistic Hypothesis, but on the basis of a robust metaphysical realism. The aim of this approach to pluralism is to capture more fully the sense of mystics from diverse religious traditions that they have actually perceived the Real as such, and not merely one of its phenomenal appearances. This is an anthology in which all but one of the essays have been previously published. Western religious thought has made use of, or appropriated, or remained in dialogue with every major philosophical development from Platonism to Marxism. One of the latest versions of such appropriation, discovered as many would think in a most unlikely place, is the appropriation of analytic philosophy. A new natural theology is abroad in the land, and this volume attempts quite successfully to capture its current (...) state. If Flew and MacIntyre offered the first version of this dialogue and found analytic philosophy detrimental to western theism, this volume recognizes that more recent analytic philosophy has offered a second version and discovered analytic methodology as supportive of theistic philosophical persuasions. Essays by Ross, Rowe, Swinburne and Horsburgh consider the contribution of modal logic. Other essays by Alston, Bennett, and Hick, discuss the divine nature. Language and religion is developed by Ross, Pike, Plantinga, Rowe, Kenny, Mavrodes, Savage, and Donnelly. Miracle language is investigated by Holland and Dietl, while Gill discusses verification, and Chisholm the self. Although one may regret that some writers, Geach or Phillips, for example, are not included, it is time to recognize that natural theology has revived in our day by means of analytic philosophy, and this collection is an early and very successful reminder, as well as functioning as a good text for courses in the latest in philosophical theology on the Anglo-Saxon scene.—H. The concepts of necessary being, or necessary existence, and contingent being, or contingent existence, continue to occupy a central position in philosophical appraisals of Christian theism. Some philosophers have been concerned of late to emphasize a crucial ambiguity in the terms ‘necessary’ and ‘contingent', an ambiguity which threatens seriously to bedevil assessment of the claim that God's existence is necessary and not contingent. An important consequence of getting clear on this point, it is suggested, is that certain brisk attempts to (...) demolish the concept of a necessary being may be seen at least to be premature, leaving untouched,, as they do, an apparently viable sense in which God can be said to be a, indeed the, necessary being.This, substantially, is the position advocated by Professor J.H. Hick in recent discussions of this point. Hick maintains that it is of the greatest importance to distinguish two fundamentally different and contrasting notions of necessary being or necessary existence. (shrink)

Having cited Dionysius as one of the many Christian thinkers who affirm the ineffability, or transcategoriality, of God in God's ultimate inner being, I respond to Timothy D. Knepper's claim that this is a mistake. Whilst accepting much that he says about Dionysius, I still prefer the standard interpretation of the Dionysian texts as teaching the total transcategoriality of the Transcendent as 'surpassing all discourse and all knowledge'.

ISBN: 0 88344 723 1. pp. 301. Griffiths presents a rigorous argument for the possibility of con· (...) tradictory claims between different religious communities. His inspira· tion, as he acknowledges, is William Christian Snr. His basic argu· ment is: " If representative intellectuals belonging to some specific religious community come to judge at a particular time that some or all of their own doctrine-expressing sentences are incompatible with some alien religious claim(s), then they should feel obliged to engage in both positive and negative apologetics vis-a-vis these alien religious claim(s) and their promulgators" (3). He takes negative apologetics to be a critique of arguments made against one's own religious claims, showing that such arguments fail or are inconsistent or incoherent. Positive apologetics shows how a particular religious community's doctrines are cognitively superior, in some respect(s), to another religious community 's doctrines. It is essential for this enterprise that only methods of argumentation and criteria of knowledge acceptable to the adversary are employed. This requires the acceptance of natural theology. Griffiths is well aware of the lion's den he is entering, as his proposals run counter to much scholarship in the area of interreligious dialogue, so he spends three chapters apologetically tackling the lions. The objectors (who mainly remain in notes) include Derrida, Barthes, Winch, Lindbeck, Hick, Huxley, Nasr, Plantinga and others, although Mac· Intyre is curiously missing. This technique has the advantage of isolating and presenting arguments, without falling into problems of cor· rect exegesis of opponents. And this is also its weakness, as objectors will sometimes feel caricatured or misunderstood-as is surely the case with Plantinga and in one instance, Hick. First, he tackles objections that sentences from one tradition are either incomprehensible or incommensurable with those of another, convincingly showing that the strong versions of both claims are self· defeating and unsustainable. Weaker versions still allow for his proj· ect-or so he thinks. This is where Maclntyre's work should have been considered. Then he tackles various theories of religious language (following Lindbeck's typology). He argues against non-cognitive accounts that reduce beliefs to the credibility of causes for holding beliefs, a position incapable of asserting its truth over other views because of its 720 BOOK REVIEWS own presuppositions. He follows Lindbeck in criticizing experiental expressivism, and then turns upon Lindbeck's own form of rule theory (which is ambivalent regarding cognitive claims), arguing convincingly that to suggest that only sentences uttered confessionally and with performative function can possess ontological truth is confused (42). In a brief review it is not possible to rehearse Griffiths's careful argumentation. Griffiths then sets about tackling two types of universalists: Hick and Huxley. Of Hick, he argues that some criteria are required to discern true from false religions (e.g. Jim Jones) and in so doing such a position needs to support and develop such criteria, thereby effectively introducing apologetics. He neglects to deal with Hick's pragmatic criteria of beneficial ' fruits ' evident in adherents, but the logic of his argument can be applied to Hick's proposals. Using Katz and Zaehner, he argues against the esoteric universalism of the philosophia perennis. (The arguments of Robert Forman's recent book, The Problems of Pure Consciousness, are strangely neglected, despite Griffiths's being a contributor to that collection.) Finally, he tackles objections against positive apologetics-first, on the grounds that it has a negative effect on interreligious relations. Logically, this need not be the case, although Griffiths is well aware that the political context of apologetics can obscure its proper goal: deeper critical understanding, learning and problem solving. Then, in sustained dialogue with Plantinga, he argues against the objection that success is impossible. It is impossible only if " knockdown drag-out" (64) argumentative victory is expected. InStabilizing Dynamics Roy Weintraub provides a history of stability theory from the work of Hicks and Samuelson in the late 1930s to the Gale and Scarf counterexamples in the 1960s. Unlike his earlier work in the history of general equilibrium theory this recent contribution is not an attempt to fit the Walrasian program into the narrow framework of some particular philosophy of natural science. Rather, the theme inStabilizing Dynamicsis broadly social constructivist. SummaryEarly geological investigations in the St David's area (Pembrokeshire) are described, particularly the work of Murchison. In a reconnaissance survey in 1835, he regarded a ridge of rocks at St David's as intrusive in unfossiliferous Cambrian; and the early Survey mapping (chiefly the work of Aveline and Ramsay) was conducted on that assumption, leading to the publication of maps in 1845 and 1857. The latter represented the margins of the St David's ridge as ‘Altered Cambrian’. So the supposedly intrusive ‘syenite’ (...) was regarded as younger, and there was no Precambrian. These views were challenged by a local doctor, Henry Hicks, who developed an idea of the ex-Survey palaeontologist John Salter that the rocks of the ridge were stratified and had formed a Precambrian island, round which Cambrian sediments (now confirmed by fossil discoveries) had been deposited. Hicks subsequently proposed subdivision of his Precambrian into ‘Dimetian’, ‘Pebidian’, and (later) ‘Arvonian’, and he attempted correlations with rocks in Shropshire, North Wales, and even North America, seeking to develop the neo-Neptunist ideas of Sterry Hunt. The challenge to the Survey's work was countered in the 1880s by the Director General, Geikie, who showed that Hicks's idea of stratification in the Dimetian was mistaken. A heated controversy developed, several amateur geologists, supported by a group of Cambridge Sedgwickians, forming a coalition of ‘Archaeans’ against the Survey. Geikie was supported by Lloyd Morgan. Attention focused particularly on Ogof Lle-sugn Cave and St Non's Arch, with theory/controversy-ladenness of observations evident on both sides. Evidence from an eyewitness student record of a Geological Society meeting reveals the ‘sanit`ized’ nature of the official summary of the debate in QJGS. Field mapping early in the twentieth century by J. F. N. Green allowed a compromise consensus to be achieved, but Green's evidence for unconformity between the Cambrian and the Dimetian, obtained by excavation, can no longer be verified, and his consensual history of the area may need revision. Unconformity between the Cambrian and the Pebidian tuffs is not in doubt, however, and Precambrian at St David's is accepted. The study exhibits features of geological controversy and the British geological community in the nineteenth century. It also furnishes a further instance of the great influence of Murchison in nineteenth-century British geology and the side-effects of his controversy with Sedgwick. (shrink)

For decisions between many alternatives, the benchmark result is Hick's Law: that response time increases log-linearly with the number of choice alternatives. Even when Hick's Law is observed for response times, divergent results have been observed for error rates—sometimes error rates increase with the number of choice alternatives, and sometimes they are constant. We provide evidence from two experiments that error rates are mostly independent of the number of choice alternatives, unless context effects induce participants to trade speed for accuracy (...) across conditions. Error rate data have previously been used to discriminate between competing theoretical accounts of Hick's Law, and our results question the validity of those conclusions. We show that a previously dismissed optimal observer model might provide a parsimonious account of both response time and error rate data. The model suggests that people approximate Bayesian inference in multi-alternative choice, except for some perceptual limitations. (shrink)

Ship design needs to respond to and attract an ever more design conscious society. However, little research has been conducted into perceptions of beauty and pleasure and how such perceptions can be usefully absorbed into ship design. Aesthetic consideration, is seen as a distraction from the bespoke nature of the ship design process and is often avoided, second guessed or left for external consultancy. The ship design discipline requires the nurturing of its own aesthetic methods, for future development, and to (...) adapt some of the aesthetic ideals found in architecture, art and design. This paper argues that philosophy can be effective in interpreting what the passenger finds attractive and pleasurable. To illustrate the philosophical approach proposed, the `Elbe SWATH’ and the `Oasis of the Seas’ are investigated and compared using theoretical resources from the culturally focused philosophy of `Functional Beauty’. Conclusions suggest that the interpretation of the end users most valued appreciations can lead to design directives that deliver subjective qualities of beauty - beauty similar to those seen in the pure aims of the Elbe SWATH’s purposeful work craft, or comparable to nature’s beauty and purity in aim. If you believe in the existence of an infinitely good, all-knowing, and all-powerful deity (‘God’), how do you explain the reality of evil – including the inexpressible suffering and death of innocents? Wouldn't God be forced to vanquish such suffering due to God's very nature? Alvin Plantinga has argued, convincingly, that if the possibility of ultimate goodness somehow necessarily required that evil be allowed to exist, God, being omnibenevolent, would have to allow it. But as John Hick has noted, the (...) mere logical possibility of such a situation might not be enough to console the doubting theist. We need a positive reason to believe that evil as we know it is compatible with God's existence. So, Hick offers a ‘soul-making’ theodicy – or vindication – of God, suggesting that the human soul cannot fully progress to spiritual maturity (a kind of ultimate good on his account) without grappling with evil. In this short piece I argue that, if we accept Hick's premises about souls and soul-making, we can indeed make sense of evil to some extent. But, I suggest, his account cannot justify the type or amount of evil we see in the world, so his theodicy does not succeed. (shrink)

It is an undeniable reality that workplace spirituality has received growing attention during the last decade. This fact is attributable to many factors, socioeconomic, cultural and others [Hicks, D.A. 2003: Religion and the Workplace. Pluralism, Sprtituality, Leadership (Cambridge University press, Cambridge)]. However the field is full of obscurity and imprecision for the researcher, the practitioner, the organisational analyst and whoever attempts to systematically approach this relatively new inquiry field. This article attempts to provide a critical review of the literature (...) on workplace spirituality by examining the underlying rationale of the main trends regarding spirit at Work and by negotiating their strengths and weaknesses. Current approaches to workplace spirituality are distinguished to the exploratory, contextual and the consequential, acontextual ones. Particular attention is given to ‚Respectful Pluralism’ proposed by Douglas Hicks, as it is suggested that this theoretical framework is the most well-founded, elaborated and systematic up to date. However, it is proposed that even ‚Respectful Pluralism’ fails to fully capture the complexity of such a multidimensional phenomenon as spirituality. Drawing on mainstream ethical and philosophical traditions (deontology, utilitarianism, virtue ethics) supporting alternative value-systems, it is suggested that a more inclusive and philosophically affluent framework needs to be developed. How should we make interpersonal comparisons of well-being levels and differences? One branch of welfare economics eschews such comparisons, which are seen as impossible or unknowable; normative evaluation is based upon criteria such as Pareto or Kaldor-Hicks efficiency that require no interpersonal comparability. A different branch of welfare economics, for example optimal tax theory, uses “social welfare functions” to compare social states and governmental policies. Interpersonally comparable utility numbers provide the input for SWFs. But this scholarly tradition has never (...) adequately explained the basis for these numbers. John Harsanyi, in his work on so-called “extended preferences,” advanced a fruitful idea. While an ordinary preference is a ranking of outcomes, an “extended preference” is a ranking of individual histories. To say that individual k has an extended preference for history over means something like the following: k prefers to have the attributes of individual i in outcome x, as opposed to having the attributes of individual j in outcome y. Harsanyi’s proposal was to endow individuals with “extended preferences”; to represent such preferences using “extended” utility functions; and to employ such functions, in turn, as the basis for interpersonal comparisons of well-being levels and differences. Harsanyi’s analysis, however, had various gaps and flaws. In this Article, I both diagnose these difficulties, and show how they can be remedied - yielding a viable account of interpersonal comparisons, one sufficient for the needs of the SWF approach. Eugene, OR: Cascade Books, 2006. 116 + xii pp.Paul Ingram of Pacific Lutheran University is a long-time veteran of Buddhist-Christian dialogue and a generous contributor to the Society for Buddhist-Christian Studies. His earlier book, Wrestling with the Ox, took the famous Zen ox herding pictures as an entry point for reflecting on the transformation of identity that (...) can take place in Buddhist-Christian relations. The present book opens with the image of Jacob wrestling with God in Genesis 32 as a launching point for exploring religious diversity in a world ever more shaped by natural science. Ingram's thesis is that "Christianity is now in a process of decay and that dialogue with the world's religions—especially Buddhism—and Christian dialogue with the natural sciences are the two most important intellectual foci for thinking Christians" (p. x).Relating his position to that of John Hick while questioning Hick's Kantian epistemology, Ingram proposes a pluralistic evaluation of the world's religious traditions—or at least some forms of them. Ingram seeks to be deeply rooted in the Christian tradition while being open to the legitimate variety of other religions. Nonetheless, Ingram has rather harsh words to say about "legalists and fundamentalists" without ever offering a precise definition of who is included in these terms. He describes fundamentalists in all religious traditions as "trapped in the conventional categories of their ideologies" (p. 21), but what counts as "conventional categories" or as "ideologies" is never fully clarified.Ingram rejects any tradition's claim to have "the final or the exclusive or the inclusive Word about God" because this would be a form of idolatry, which Muslims call shirk (p. 19). Ingram's position would appear to condemn a very wide spectrum, including traditional Christians and Muslims who believe that their respective scriptures express God's final revelation. Such a grouping would appear to be far broader than those conventionally labeled "fundamentalist." For example, Vatican II's Dogmatic Constitution on Divine Revelation (Dei Verbum) expresses the traditional Catholic belief that Jesus Christ is the center of revelation and no further public revelation is to be expected before his Second Coming; the constitution also accepts historical criticism of the Bible and thus does not fit the usual model of "fundamentalism." Because "fundamentalist" is frequently not a contemporary form of self-designation, it would be helpful to have more specific guidance on how Ingram wishes to apply the term, especially to contexts that are not Christian. If all those who firmly hold traditional doctrinal views are included under this umbrella, Ingram's pluralistic thesis presents itself as firmly rejecting a considerable range of the world's religious traditions.Citing Alfred North Whitehead and contemporary physics, Ingram finds plurality and interdependence to be at the heart of all forms of existence, "from sub-atomic [End Page 201] particles to religious traditions to God" (p. 20). This is a clear rejection of the Muslim doctrine of tawhid, the radical oneness of God, which for Muslims excludes any notion of Trinity or plurality or interdependence in God. Cost-benefit analysis —understood as a technique for evaluating governmental policies in light of individual well-being—rests upon a preference view of welfare. A policy’s effect on a given individual is measured, on a money scale, with reference to her preferences as between money and other goods, captured in her “utility” function. This chapter describes the methodology of CBA, and discusses the various conditions on individual preferences that are required for the existence of an individual utility function, for the use of money (...) as a scale for measuring policy effects, and for a nexus between an individual’s preference-satisfaction and her well-being. The chapter then turns to the topic of interpersonal welfare comparisons. Although CBA is often defended with reference to the criterion of Kaldor-Hicks efficiency, which eschews such comparisons, a more plausible defense embraces them and sees CBA as an approximation to a social welfare function. This article aims to provide a semiotic analysis of environmental law and youth protests. More precisely, drawing on speech act theory this article regards both as types of communication and teases out the inherent voice and message, specifically with regard to the interests of future generations. The argument unfolds in three steps. First, the article looks into speaker and speech of environmental law and argues that it speaks, as legislation does, in the first-person plural voice of a ‘we’. Second, the (...) article examines a speech of Greta Thunberg through the lens of Stanley Cavell’s theory of passionate utterances. This interpretation will unlock the political stakes of Thunberg’s speech as she claims standing with those responsible for enacting environmental law. Finally, the consequences of this reading will be analysed by relating message and voice of environmental law. As youth protests question ordinary forms of political representation, new ways of safeguarding the interests of future generations are called upon. (shrink)
